Kamleh Nicola is a partner at Marks & Clerk and Co-Head of the firm’s Litigation practice in Canada. Her intellectual property litigation practice centers around patent, trademark and copyright disputes. Though her client base is broad in scope, she specializes in Health and Life Sciences, working with domestic and multinational pharmaceutical, biopharma and MedTech organizations.
Kamleh thrives in complex contentious situations and is adept at handling legal cases across multiple jurisdictions. She is well-known for her ability to understand her clients’ risk profiles and business goals and stay focused throughout, from planning the case strategy to resolution. Prized for her extensive knowledge of the Patented Medicines (Notice of Compliance) Regulations and the Food and Drugs Act, Kamleh a highly regarded advisor on issues involving patent linkage regimes, as well as trade secret, health regulatory and compliance matters. She also advises on transactional and post-acquisition integration matters.
Prior to joining Marks & Clerk, Kamleh was a partner at two other top-tier Canadian law firms where she represented clients on many intellectual property legal matters including patent impeachment and infringement, inventorship disputes, Notice of Compliance proceedings, trademark and copyright infringement, health regulatory, compliance and licensing disputes. She has authored, and co-authored, many publications on IP, regulatory and litigation subjects and is a frequent presenter at legal and industry events, at home and abroad.
