Help in mentioning a variable source

A tag was put on my upload saying its a derivative work, File:Tæm̆bili Pandol 2024 Enderamulla Church Feast.jpg; should i mention all the villagers who made this pandol? I don't understand the requirment. pls explain this matter. its like asking to mention all the people who helped to build a christmas tree thats in a pic. Whats the solution on this. And no this is not sponsored by the mentioned church, its just a pandol made by villagers as a tradition. Whom should i mention as source? i hv already mentioned own since i took the photo. The photo appears to be on Facebook, posted prior to your upload here by an account whose name does not match yours, and tagged all-rights-reserved there. But even if you did take the photograph, there is no freedom of panorama in Sri Lanka, so you would actually seem to need explicit permission from each of the builders and/or designers. I just read the section 8, from what i understad is;
Section 8: Works Not Protected by Copyright
This section explains that certain elements are not protected by copyright, which includes Ideas, concepts, procedures, methods of operation, or mathematical concepts as such.
This means that ideas, methods, or concepts in and of themselves are not subject to copyright protection. Only their expression in a tangible form can be protected. So, if a decorative arch (like a Thambili Thorana) follows a traditional or widely known pattern, it might not qualify for protection unless there is some new, original expression or design in its creation (which havent changed since the begining of the tradition).
While the Act does not specifically mention "traditional cultural expressions" or "public domain," it's generally understood in copyright law that elements that are part of cultural heritage or have been in long-standing public use may fall outside copyright protection unless there's an original aspect added to the work.
Thus, if a decorative arch is based on cultural traditions or forms, it is likely not protected unless new, creative, or original elements are introduced into its design or structure (again, the pandol form has never being changed in the history since the begining).
here you can see picture o fthe pandol over the years. Its the same traditional design. oldest available picture is from 1990 and 1991(100th jubilee).more older picture wouldnt hv been available since even in 1991 only one man owned a camera in the whole parish. Isn't a construction of something "a tangible form"? Taking that this is literally the same thing that has been re-built every year and that the original designer is not known, protection for anonymous works lasts 70 years. If it's been modified, then that might reset the clock. And the copyright law explicitly says "expression of folklore" are protected. DMacks (talk) 20:48, 21 September 2024 (UTC)Reply

i might be wrong but i feel like in this case, if they had originally named the file let say "view of an old church in sri lanka, during a feast celebration" this might have a different outcome. since it does not emphasize on a item in the pic but a general view one might see. The name doesn't matter if the content is unacceptable: the protected part of the image is not de minimis. Sometimes we get lucky and it's easier to catch potentially problematic content. Licensing policy is complicated, as you are learning. DMacks (talk)

@VihirLak007: Very good question: is there enough originality in this particular expression of traditional folk art to qualify for copyright? Help with identifying a grasshopper species (and species in general)

Hi,

I uploaded some photos of a grasshopper earlier today (e.g., File:20240920 greasshopper on corn point meadows PD205782.jpg).

I thought I had identified the correct species, but now I'm not so sure.

Wondering if there is a place on WM where I can get advice on the correct species.

@Pdanese: I see that the species has now been IDd, but in future you can apply categories like Category:Unidentified insects or one of its sub-categories; or you can upload your images to iNaturalist (but please still upload them here also). Using iNaturalist has the added advantage that your record contributes to the scientific monitoring of biodiversity; see com:INaturalist. @Nightryder84: Commons doesn't accept content that's been released under a non-commercial license per COM:LJ; so, Commons is unlikely going to be able to keep this file because the licensing the UT Southwestern Image Archives is using is too restrictive for Commons. Given the information on the photo found at here, it seems likely that someone working for UT Southwestern took the photo in 1991 as part of their duties in a sort of en:work for hire type of arrangement, which means UT Southwestern is most likely the copyright holder; so, you would need its COM:CONSENT for the file to be kept on Commons. Others might assess this file's copyright differently, and you can wait to see if others respond if you want; however, I think your two options here are to ask the UTSW for its consent or tag the file for speedy deletion yourself per COM:CSD#G7. If you do nothing, the file will most likely tagged for speedy deletion by another Commons user per COM:CSD#F1 or COM:CSD#F4. -- Marchjuly (talk) 05:29, 25 September 2024 (UTC)Reply

@Adry9509: Assuming you mean the Main Page of the Simple English Wikipedia, that would be a matter for that project's policies. It's easy enough to confirm that the source video on YouTube is marked with a CC BY 3.0 licence. But there is always the question of whether the channel that posted the video actually had the right to grant that licence. In this case, it's notable that there's a corresponding video on the main Vogue channel, and it isn't marked CC BY 3.0. So the question is, does Vogue Taiwan have the right to relicense videos from Vogue under a free licence? And while I was writing this it seems that Aafi has decided that the answer is "yes". --bjh21 (talk) 11:04, 25 September 2024 (UTC)Reply
@Bjh21, thanks for bringing this up. Well, frankly, I did no go too deep into this and trusted the statement by VOGUE Taiwan that the file is freely licensed. Given that the original video (published two days earlier) doesn't put up any such claim, I share same concerns as you. I can simply revert my closure and ask other admins to take a look. Problems uploading a file

Hi,

I tried to upload a 1.5 GByte PDF file. I got various error messages. Currently I constantly keep getting "Pathologie4.pdf Could not acquire lock. Somebody else is doing something to this file." Before that I got something like "Server did not respond in the expected time". And just now I got "Internal error: Server failed to publish temporary file."

any ideas?

Hi, I have a question regarding U.S. State Department copyright law as it pertains to ambassadors. Since ambassadors operate under the jurisdiction of the Department of State, I understand that images depicting their official duties are considered public domain. Does this mean that any images they upload to social media platforms (such as Twitter/X) while performing their official duties are also in the public domain and, as such, can be used on Wikipedia? Hi Titanciwiki I believe it depends on who takes the photograph and where its published. If, for example, the photograph is taken by an employee of the US embassy (who isn't a local contract hire), it's taken as part of their official duties, and it's uploaded to an official US Government website (social media account), then perhaps it would fall under {{PD-USGov-DOS}}. On the other hand, if the photo was taken by someone else (e.g. a photographer working for the host country) but just is being hosted on an official US Government website (social media account) or is being hosted on someone's personal website or social media account (even if the person is a US government employee), then it might not be considered and official work of the US Government and thus could be eligible for copyright protection. This links to the copyright information page for the US Embassy in the UK, and I'd image most the other US embassies worldwide have similar pages. If that's not sufficient for you to do a self-assessment of the photo you want to use, it would probably be easier for someone to help you if could provide a link to the photo want to upload.
Finally and just for reference, Commons is mainly concerned with the licensing of the content it hosts and whether it meets COM:SCOPE. Commons isn't too concerned with how the content it hosts is being used by the various Wikimedia Foundation projects like English Wikipedia. Encyclopedic decisions regarding image tend to be left to each project to sort out; so, Commons hosting something doesn't automatically guarantee that a project will decide to use it, and such things sometimes need to be resolved through discussion at the local project level. -- Marchjuly (talk) 07:30, 26 September 2024 (UTC)Reply

The page you link states "2024 © Інститут енциклопедичних досліджень НАН України", so for that particular photo to be allowed on Commons, you need the permission of the copyright holder, usually the photographer. But I don't know if they are free for distribution. Can anyone help me confirm this? They give credit to: "Photo: Kraw Penas/SEEC" and make them available for: "Download in high resolution"

Issues with uploading a new version of an SVG

I'm not able to upload a new version of File:Forms of government.svg. I've checked the metadata, and there's no HTML in there, so I have no idea what the issue is. I've even attempted to reupload the file in its current state and the same error has shown up, the only way to change this file currently is by reverting it to previous revisions. – GlowstoneUnknown (Talk) 01:25, 27 September 2024 (UTC)Reply

Uploaded new version unsucessful

Hi, I decided to add unblurred higher quality images to a screenshot I uploaded last year.

 

The Talhenbont Hall floor plan file I added last year has been replaced, but is still showing up as the current image as it's blurred and doesn't zoom in well. I first added a better screenshot of a book, however the image was still blurred. I then unblurred the image, but when I uploaded the new image, it still didn't upload correctly, so I reverted twice without success, and added a new file again, but still the latest uploaded image is of the first original upload of low quality which does not zoom correctly. Any idea please as to why the current image isn't uploaded correctly and is still using the original upload ? Please take a look at this similar image which I uploaded successfully as a newly unblurred upgraded image. Whilst a third image also has the same issue of not fully uploading the newer unblurred screenshot. You just have to compare image sizes, now over 1mb compared to before to see the uploads were successful, just they are not being displayed correctly. Any ideas how to fix this issue please ?? It is a bit more than that; the near duplicate is appallingly bad low resolution, and may have been uploaded by a user who was blocked around ten years ago. That must be more than enough enough justification.

FYI; I am (or was) an aircraft enthusiast, and I confirm that the two images are of the same individual Wing Commander's aircraft (serial 81-0979), same location, same date, just a slightly different angle. I wasn't there myself, but it was a photo-shoot at RAF Waddington, 27 April 1990, open to the public, with around 50 aircraft arranged specifically for the cameras.

Meanwhile, I will manually visit the 3 or 4 pages that have mistakenly opted for the low-res version simply because it mentioned the Wing Commander connection. Give me 20 minutes head start to switch the images on these pages.

Hi, the photo is presumably copyrighted and can't be uploaded here at Commons; the creator/copyright holder of the file would have to release it under a free license. Licensing status of a photo that was used under false pretenses

I've just moved File:Willie Hagan.jpg to that title from File:Fretïmio Assocão di Planka.jpg based on its EXIF data and a post at a Wikipedia criticism site. en:Fretïmio Assocão di Planka has been deleted as a hoax. It's a 2010 photo, based on EXIF data, and is credited in those data to several photographers, presumably a firm, working for a branch of California State University. I'm unsure whether Commons has permission to use it. Help regarding an answer to that question, please, and if it is ok for it to remain, could someone fill out the necessary form fields? It seems like this could be speedily deleted per COM:CSD#G3 or COM:CSD#F6 since the original license was obviously an intentional attempt at COM:LL and the file's use could be seen as violation of the personality rights of the subject of the photo (even if he was unaware of it); moreover, there's already a photo of the subject being used in en:Willie J. Hagan (assuming that's the same person) which means an immediate use for this photo isn't apparent. If the EXIF data is correct, the copyright holder would either be Karen Tapia or the university; so, hers or its COM:CONSENT would be needed for this to be kept, unless someone wants to argue this is {{PD-CAGov}}. FWIW, this seems to be the same Karen Tapia, and she seems to have worked for the university around the time the photo is supposed to have been taken; furthermore, the university does seem to be claiming copyright ownership of photos currently appearing on its official website. -- Marchjuly (talk) 07:02, 28 September 2024 (UTC)Reply

Informal(?) permission to upload article not in public domain

Back in January, while constructing Halenbeck Hall, I found a photo by the St. Cloud State University Archives Facebook page that was a black and white exterior of the building from 1980. I asked whether or not I could use the photo for the Wikipedia page on their Facebook post, and they said I could as long as I credit them. The question is...would getting permission on Facebook be considered acceptable, or should I have gone for a more formal approach by emailing them? I will provide the link to the granted permission if requested. I never noticed that St. Cloud State University Archives responded to me all the way back in January until moments ago. Thanks. @Wjenkins96 Thanks for trying. It's possible, but has to be done right, see the FB section at WP:A picture of you. This assumes that the FB "holder" is the copyright holder, otherwise the copyright holder (usually the photographer) has to give permission via some other route on that page, like COM:VRT. Permission routes?

Hello I've been reading a lot of help pages (and this forum) and am struggling to find a list of examples of acceptable proof of permission sources. If, for example, you emailed someone and got a response to approve - how would you use that on here?. Trying to figure out the best way to seek permission (to change a person's image) that would be acceptable to your wizard / guidelines etc. Thx. Duplicate image (1943 flying boat)

Please forgive me, but having read through pages and pages (& more pages) of instructions regarding duplicate images / deletion requests / deletion policy, I am developing a migraine headache and slowly losing the will to live. It should be a simple case for "speedydeletion", but my head is spinning and I don't feel confident enough to proceed on my own.

Summary (AFAIK); both images come from the same PD source (Imperial War Museum). Both are jpeg, and FYI the photo date is circa 1943. The file descriptions are slightly different, but mostly they cover the same detail.

  • Image #1 is 144kb, was uploaded in 2012, and appears slightly lighter, with poorer contrast, but these are my subjective assessments.

  • Image #2 is just 26kb, was uploaded in 2014, is tagged because it is a scan/photocopy (?), is much lower resolution but possibly better contrast.

(apologies for not providing better links, but even my browser is suffering fatigue, and will not pick up the thumbnail links, although adding thumbnails to this discussion page is probably not a good thing)

So, does this instance warrant any kind of discussion, or should I simply tag for speedydeletion and trust the process to pick up the pieces? And where exactly do I place the tag? Am I reading the guidelines too literally, and worrying over every last detail, when the main factor is 26kb versus 144kb?

@WendlingCrusader: Yes, the written rules around deletion of duplicates are a bit of a tangle, so without experience it can be hard to work out how things work. In this case I think the answer is clear: this is not a case for speedy deletion. At least on my browser, the images are very different: File:British Overseas Airways Corporation and Qantas, 1940-1945. CH14743.jpg has much more contrast than File:IWM-CH14743 Boeing 314 205210663.jpg, so the plane is much darker but the background is lighter. That means that COM:CSD#F8 doesn't apply: the newer file is not an exact duplicate of the older one. So if you want a file deleted, you'll need to open a full deletion request for it, following COM:Redundant. Personally, I'd just add each file to the other's "other_versions" and let them both be. --bjh21 (talk) 14:30, 2 October 2024 (UTC)Reply

EU multimedia

Hello. I have been wondering. So, I have been uploading images from the European Commission as I know those images are okay to upload on to Commons. Recently, I have also seen images from the European Parliament being uploaded under the European Union Government license. So my question is if it's also alright to upload these images as well? What is the best place for a discussion about Commons categories? I am slowly chipping away at tidying and better organizing c:Category:Industrial design and related categories – and, I hope, if successful, improving internal query results for "industrial design" (which, as of today, shows many irrelevant images interspersed with the useful/accurate information). Most of my experience is in English wikipedia and Wikidata, although I do have some useful experience here in Commons too. I am a decent existing professional and human being who wants to put an end to this situation of garnishing a story with a photo. It sounds very simple, but it has been very frustrating. These are both highly professional pictures, on two very different public individuals' Facebook accounts, with no credit to the photographer. The copyright may belong to the photographer or may have been transferred to the individuals photographed, given that they used them. Are you the photographer who is apparently Josué Ricardo Rivas? Can you prove that via COM:VRT? Unless we get provable authorization from the copyright holder freeing the license in that manner, we cannot host these images. The upload wizard will import an image's description from its XMP description (XMP::dc\description\Description). Is there a way to do the same with the caption? I have had two [1 and 2] of my photos marked with a deletion request. On both I have made points for the photo's value. People have made arbitrary statements for deletion and not even addressed my points for the photo's values. Regardless of the nudity aspect, these pictures are selfies, and the arguments just seem like every other argument for justifying selfies on Commons. Every selfie is unique and can be used to illustrate all sorts of things. Ultimately for our purposes, it's just additional junk. The fact that we already have a massive abundance of nudes that our people have to look through is simply icing on the cake. @Tylermack999 I'm not very familiar with geni.com, all that image page says is "© 2024 Geni.com" which on the face of it says "can't be on Commons". I suppose you could try to ask the geni-uploader for additional info about date and country of origin. However, since the subject is dead, you can consider uploading it on en-WP as a non-free file at WP:FUW and use it as leadimage, BUT you can only do that when your draft is in mainspace (is an actual article). Question about editing distorted candidate images licensed by the TSE (Supreme Electoral Court of Brazil)

Hello everyone,

I have a question regarding some images of candidates that have been uploaded to Wikimedia Commons during the election period. Thanks to the Tribunal Superior Eleitoral (TSE), which allows the inclusion of candidate photos under the Creative Commons Attribution 4.0 International license, thousands of images have been added to the platform, which is correct since they are properly licensed.

However, I noticed that some of these images, such as those of Pablo Marçal and his running mate Antonia de Jesus, have visible distortions that affect their quality. Here are the examples:

I used an AI tool to enhance the quality, but my edit was reverted, as community members preferred to keep the original version.

My question is: for these distorted candidate images, can I edit them to improve their visual quality by adjusting proportions and resizing in Photoshop and then upload them as new versions on Wikimedia Commons? Or should I leave them as originally uploaded to avoid possible reversion?

I don't believe we have a solid policy on AI upscaling or clarifying. I don't see anything about it in COM:AI, but AI improved photograph should be clearly labeled as such, including categorization, and they should generally not be used to substitute for the original image unless it is clear to the end user that it is an AI-improved image. Just to be clear, AI "improvements" often winds up distorting the subject in ways that are obvious to some people but not to others, so great care must be used in using these. Incorrect Wikidata item associated with a category

Category:Frida Beckman contains one photo, of a professor by that name. It is associated with a Wikidata item (wikidata:Q19631570), which represents a different person (an actor) by the same name. I've tried to disentangle them by removing the Wikidata infobox from the category, and by removing the Commons category from the Wikidata item, but there has to be something I'm doing wrong because bots always show up to undo my edits! how do I use a promotional photo in wiki article that was given to media and public

I have several glossy promotional photos of equipment (one also contains a person) given to media and public in 1980's with permission to use them at the time. They gave them away at trade shows without any copyright markings. They were keen to promote the technology and product. The company that gave the photos away ceased to operate ~ 1981 and was later dissolved. One photo contains an image of a person who is deceased ~ 1991. For purpose of putting the photo with person in a wiki article, the face of the person could be blurred out if there is no way to publish it otherwise. is that OK. . Note that I acquired the remaining assets of that company as one of the sucessor companies that last held the assets went through receivership as part of being dissolved. I got a big truckoad of gear as well as a few remaining records and an envelope full of photos and brochures. None of the photos or brochures have copyright markings. Is this information doomed to rot in my archives till I pass away and my kids toss it or is there some way to share it on wiki where the original article is. I have noticed that several books which I uploaded time ago can not be displayed by the Commons PDF media viewr. I have already tried to purge the file pages / cash but it did not help. Can anyone help me, please?
